These Terms of Use (“Terms”) govern your access to and use of the website, programs, consultations, educational materials, testing-related services, and other offerings made available by Austin Transformational Health dba Your Gut Story (“Your Gut Story,” “YGS,” “we,” “our,” or “us”) through our website and related services (collectively, the “Services”).

By accessing or using the Services, or by purchasing any service or product from us, you agree to these Terms. If you do not agree, do not use the Services.

Our Privacy Policy is incorporated into these Terms by reference.

1. Eligibility

You must be at least 18 years old to use the Services, unless a parent or legal guardian is authorized to act on behalf of a minor in connection with a permitted service.

By using the Services, you represent that:

  • you are legally able to enter into this agreement
  • the information you provide is truthful, accurate, and current
  • you are authorized to provide any information submitted on behalf of another person

For minors under 18, a parent or legal guardian must complete the order and consent process where a minor is permitted to receive a service.

2. Scope of Services

YGS provides a combination of educational content, wellness guidance, testing-related services, and, where applicable, consultations or interpretations provided by a licensed clinician or other qualified healthcare professional.

Services may include, depending on what you purchase or receive:

  • laboratory testing facilitation, including GI-MAP or similar testing
  • consultation services
  • educational materials
  • wellness and lifestyle guidance
  • personalized protocols or recommendations
  • administrative and support services

Certain aspects of the Services are educational, administrative, or operational in nature. General website content, newsletters, educational resources, protocols, and automated tools are provided for informational purposes only and do not replace individualized medical care.

A clinician-patient relationship is formed only when a licensed clinician has agreed to provide individualized clinical services to a user through YGS or an affiliated practice, and only to the extent of those services.

The Services are not intended for emergency use. If you are experiencing a medical emergency, call 911 or seek immediate emergency medical care.

3. No Guaranteed Outcomes

YGS does not guarantee any specific health, wellness, or clinical outcome.

Individual responses to dietary, lifestyle, supplement, or other wellness recommendations vary widely. Any information, interpretation, or recommendation provided through the Services is intended to support informed decision-making, not to guarantee improvement, symptom resolution, cure, or any particular medical result.

4. Evolving Science and Interpretation Limitations

Scientific understanding of the microbiome, gut health, nutrition, and related wellness fields is evolving.

Laboratory interpretations, educational guidance, and recommendations offered through the Services are based on currently available scientific understanding, the information available at the time, and the professional judgment of the reviewing clinician where applicable. Interpretations and recommendations may change as new research and clinical knowledge emerge.

Laboratory testing and related reports may also reveal unexpected, incomplete, or clinically significant information.

5. Laboratory and Third-Party Provider Disclaimer

Laboratory testing, shipping, scheduling, payment processing, supplements, devices, and certain other services or products discussed or made available through the Services may be provided by independent third parties.

YGS does not control third-party laboratories, pharmacies, supplement companies, device manufacturers, shipping carriers, video conferencing platforms, payment processors, or other third-party providers, and is not responsible for their acts, omissions, products, services, testing processes, delays, outages, or errors.

Laboratory results may be incomplete, delayed, or inaccurate due to factors outside YGS’s control, including sample quality, transportation conditions, laboratory processes, medication or supplement interference, recent antibiotic use, user error, or other variables.

Where information is shared with third-party providers who perform services on our behalf, those providers are contractually required, where applicable, to maintain appropriate confidentiality and security safeguards. Each provider remains responsible for its own compliance with applicable privacy and security laws.

6. User Responsibility for Health Decisions

You remain solely responsible for determining how to apply any information, laboratory results, interpretations, or recommendations provided through the Services.

You should consult your physician or other licensed healthcare professional before making significant health, diet, supplement, medication, or treatment decisions.

Even where clinical review is included as part of the Services, laboratory findings and recommendations should be considered in the broader context of your medical history, symptoms, medications, and ongoing care.

7. Educational and Clinical Disclaimer

Information provided through the Services is intended for educational and informational purposes.

It is not a substitute for primary care, specialist care, emergency care, or individualized diagnosis and treatment from a licensed healthcare professional.

Non-clinical team members may provide operational support, general education, scheduling help, and client communications. Non-clinical personnel do not provide diagnosis, treatment, or individualized medical advice and do not create a clinician-patient relationship.

8. AI and Analytical Tools

YGS may use automated or AI-supported features to assist with education, service functionality, internal analysis, or interpretation support.

Any automated or AI-supported feature is provided for educational and informational support only. These tools may be incomplete or incorrect and do not replace the professional judgment of a licensed clinician or other qualified healthcare professional.

You should not rely on any automated or AI-generated output as the sole basis for a health decision.

9. Accounts and Security

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to notify us promptly of any unauthorized use of your account or any suspected security breach.

We are not responsible for losses arising from unauthorized access to your account caused by your failure to safeguard your credentials.

10. Payments, Purchases, and Refunds

If you purchase Services or products through YGS, you agree to provide valid payment information and authorize us and our payment processors to charge the amounts due, including applicable taxes and fees.

Prices are subject to change before purchase.

Unless otherwise stated in writing at the time of purchase, fees paid for completed consultations, completed services, shipped kits, processed tests, digital products, and rendered services are non-refundable.

If YGS offers a refund, cancellation window, credit, rescheduling policy, or replacement-kit policy for a specific offering, that policy will apply only to that offering.

We reserve the right to suspend Services for unpaid balances.

10.1 Test Kits and Samples

If your purchased service includes a test kit, you are responsible for following all collection, packaging, and shipping instructions carefully.

We are not responsible for delays, rejected samples, or compromised results caused by:

  • improper collection
  • improper packaging
  • failure to return the sample within required timeframes
  • carrier delay outside our reasonable control
  • laboratory rejection based on sample viability or quality

If a laboratory rejects a sample, YGS may, in its discretion or pursuant to the specific service policy, provide a replacement kit.

10.2 Consultation Scheduling

If a service includes a consultation, you are responsible for scheduling and attending it within any timeframe specified for that service.

Missed appointments, late cancellations, forfeited consultations, or rescheduling fees may be governed by the service-specific booking or purchase policy in effect at the time of purchase.

11. Intellectual Property

The Services, including all text, graphics, designs, logos, content, reports, protocols, educational materials, interpretation frameworks, workflows, analytical methodologies, and related materials, are owned by YGS or its licensors and are protected by intellectual property law.

The methodologies, analytical frameworks, interpretation approaches, protocols, educational materials, and recommendations provided through the Services reflect proprietary knowledge, clinical experience, and intellectual property of YGS and its providers. These materials may not be reproduced, distributed, republished, reverse engineered, or used for commercial purposes without prior written permission.

You may use the Services only for your personal, non-commercial use.

12. Prohibited Conduct

You agree not to:

  • use the Services in violation of any law
  • submit false, misleading, or unauthorized information
  • interfere with the operation or security of the Services
  • scrape, crawl, data-mine, reverse engineer, or copy the Services or their content
  • use the Services to develop a competing product or service
  • upload malicious code or harmful material
  • infringe the rights of YGS or any third party

We may suspend or terminate access to the Services for violation of these Terms.

13. Privacy and Data Use

Your use of the Services is subject to our Privacy Policy.

Subject to the Privacy Policy and applicable law, you agree that YGS may use personal information and de-identified information to operate the Services, improve programs, refine protocols, support internal research and analytics, and develop educational materials and population-level insights.

YGS does not attempt to re-identify de-identified data except as permitted by law to test de-identification methods, investigate incidents, or comply with legal obligations.

14. Feedback

If you submit ideas, suggestions, comments, or feedback regarding the Services, you grant YGS a non-exclusive, worldwide, royalty-free, perpetual license to use that feedback for any lawful business purpose without compensation to you.

15. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” TO THE MAXIMUM EXTENT PERMITTED BY LAW.

YGS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

WITHOUT LIMITING THE FOREGOING, YGS DOES NOT WARRANT THAT:

  • THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE
  • THE SERVICES OR CONTENT WILL ALWAYS BE ACCURATE, COMPLETE, OR CURRENT
  • ANY TEST RESULT, INTERPRETATION, OR RECOMMENDATION WILL MEET YOUR EXPECTATIONS
  • THE SERVICES WILL PREVENT, CURE, OR IMPROVE ANY CONDITION

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, YGS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL, BUSINESS OPPORTUNITY, OR PERSONAL DISTRESS ARISING OUT OF OR RELATING TO THE SERVICES.

TO THE FULLEST EXTENT PERMITTED BY LAW, YGS’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF:

  • $100, OR
  • THE AMOUNT PAID BY YOU TO YGS FOR THE APPLICABLE SERVICES GIVING RISE TO THE CLAIM

THIS LIMITATION DOES NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

17. Indemnification

You agree to indemnify, defend, and hold harmless YGS and its officers, directors, employees, contractors, affiliates, licensors, and agents from and against third-party claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or relating to:

  • your use or misuse of the Services
  • your violation of these Terms
  • your violation of any law or third-party right
  • information or content you submit through the Services

This indemnification obligation does not apply to claims arising solely from our gross negligence, willful misconduct, or violation of law to the extent such limitation is prohibited.

18. Arbitration and Dispute Resolution

Please read this section carefully. It affects your legal rights.

You and YGS agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration, except that either party may bring an individual claim in small claims court if eligible.

You and YGS waive any right to a jury trial and any right to participate in a class action, class arbitration, or representative proceeding.

Before initiating arbitration, either party must first send written notice of the dispute and attempt to resolve it informally within 30 days.

Arbitration will be conducted in Texas under the rules of the American Arbitration Association then in effect, unless the parties agree otherwise. If in-person arbitration would be unduly burdensome, the arbitration may be conducted virtually or by submission of documents, where permitted.

You may opt out of this arbitration provision by sending written notice to hello@yourgutstory.com within 30 days of first accepting these Terms. Your notice must include your name, email address, and a clear statement that you wish to opt out of arbitration.

Nothing in this section prevents either party from seeking temporary or injunctive relief in a court of competent jurisdiction for misuse of intellectual property or unauthorized access to the Services.

19. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles, except to the extent preempted by federal law.

Subject to the arbitration section above, any dispute that is not required to be arbitrated shall be brought exclusively in the state or federal courts located in Travis County, Texas, and the parties consent to that jurisdiction and venue.

20. Termination

We may suspend or terminate your access to the Services at any time if you violate these Terms or if we reasonably believe continued access could create legal, security, operational, or compliance risk.

You may stop using the Services at any time.

Sections that by their nature should survive termination will survive, including those regarding intellectual property, privacy and data use, disclaimers, limitation of liability, indemnification, arbitration, and governing law.

21. Miscellaneous

These Terms, together with the Privacy Policy and any additional written policies or service-specific terms provided to you, constitute the entire agreement between you and YGS regarding the Services.

If any provision is found unenforceable, the remaining provisions will remain in effect.

Our failure to enforce any provision is not a waiver of that provision.

You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale, or reorganization.
